Dental Negligence Claims

For many of us, our dentist is the healthcare professional we will see most often for much of our lives. We therefore are regularly putting our trust in them to protect an important area of our health, not to mention those times where we may want to consider restorative or cosmetic dentistry.

If your dentist, dental nurse or other dental professional makes a mistake, it can have a huge physical and psychological impact, as well as potentially leaving you facing a hefty bill to put those mistakes right. In such circumstances, it is only natural to want to try to claim compensation so you are not left responsible for the cost of correcting someone else’s mistakes.

Wolferstans medical negligence solicitors have strong experience in dental negligence claims, regularly helping our clients win significant damages. As such, we know how to effectively collect the necessary evidence and use it to build the strongest possible case so you can get a fair outcome.

We are especially well known for our focus on non-confrontational dispute resolution, which means we can typically resolve dental negligence claims without the need for court action. This can save you time, money and the stress of having to deal with a court hearing.

Due to our experience with dental negligence claims, we can value your claim with a high degree of accuracy. This helps to guard you against one of the biggest risks associated with any type of medical negligence claim – settling for less than the claim is truly worth.

We offer a free initial no obligation consultation during which we will be able to tell you if you have a claim worth investigating further.

How dental negligence claims work

Our medical negligence lawyers always aim to make the process of claiming dental negligence compensation as simple and straightforward for you as we possibly can.

A typical dental negligence compensation claim will involve:

  • Building your case e.g. applying for medical records, collecting witness evidence and consulting independent medical experts.
  • Contacting the relevant healthcare provider with the details of your claim.
  • Ensuring the defendant responds to your claim in a timely fashion.
  • Assessing the defendant’s response and advising you of your options.
  • Negotiating with the defendant and/or using alternative dispute resolution (ADR), such as mediation or independent evaluation, to secure a suitable settlement.
  • Submitting your claim to the relevant court and representing you at a court hearing where required to resolve the matter.

Funding a dental negligence claim

When dealing with the stress and emotional turmoil associated with dental negligence, we don’t want to add to your worries with concerns about how to fund a compensation claim. This is why, if we believe you have solid grounds for a claim, we will work with you to find a viable way to fund it.

Generally, the way we do this is with a ‘no win, no fee’ dental negligence claim. This works by allowing you to start a claim without needing to pay anything towards your legal fees and expenses up front, with a contribution only being required from you if we secure compensation for you.

Following a successful claim, the fee you pay us will be based on a percentage of the compensation achieved. This means you will always get to keep the bulk of any settlement or court-awarded damages, while having complete transparency at all times.

Legal expenses insurance can also be a viable option, depending on the type of cover you have. It is frequently offered as an optional extra with home insurance, as well as bank accounts and credit cards, so can be worth considering if available.

Common questions about dental negligence claims

3 years is the standard time limit for making a dental negligence claim, although it is important to note that this can be counted either from when the negligence occurred or when you became aware of it, depending on the situation.

If you need to make a claim for someone who received negligent dental care while under the age of 18, you will have until they turn 18 to do so. They will then have a further 3 years to bring a claim themselves.

There are other factors that can also affect the time limits for dental negligence claims and knowing which time limit applies can be complicated, so it is always worth consulting with an experience dental negligence claims lawyer no matter how much time has passed.

This will be based on the level of injury caused by the negligent dental work and the impact on your life.

You will typically be able to claim for specific costs, such as for remedial dental work to repair the damage caused by the negligence, as well as non-financial losses, such as pain and suffering.

To be considered negligent, the dental care would need to be shown to have fallen below clinically acceptable standards. This means that any competent dental professional in the same circumstances would not have made the same errors.

It will also need to be shown that these errors directly resulted in or contributed to damage to your teeth or other injury.
