What is a motorbike accident claim?

You can make a motorcycle accident claim if you’ve been injured on your bike and it wasn’t your fault. For example, you may have been hit by another driver, or you may have had an accident when hitting a pothole. Our experienced road traffic accident claim solicitors will listen to your story and help you gather the right evidence to support your claim.

What types of motorcycle accidents can I claim for?

There are different types of motorcycle injury claims you can make, depending on who was at fault and how severe the damages are. Causes for motorcycle accidents include:

  • Careless driving from other motorists
  • Potholes or road surfaces in poor conditions
  • Spillages on the road, such as diesel from cargo lorries
  • Pedestrians, for example, opening car doors without looking.

Your claim may be filed against a motorist, a local authority or a private company. If the accident was caused by a pedestrian, they may have public liability cover as part of household contents insurance. Throughout the process, we’ll let you know how we’re making your claim.

You may also be able to claim for damages to your vehicle. If your injuries are severe, we will work hard to get you the maximum compensation possible. If the accident was minor, we can help you claim through the Official Injury Claims Portal.

What injuries can I claim for after a motorbike accident?

Your motorcycle accident compensation claim will cover a range of injuries, from minor to severe. These may include:

  • ‘Road rash’ – cuts or scars caused by skidding on the ground
  • ‘Biker’s arm’ – crush injuries to the arm or shoulder
  • Fractures or broken bones
  • Serious back, pelvic or brain injuries
  • Emotional trauma.

Your claim will cover every injury including psychological damage, such as post-traumatic stress disorder when travelling on the road. We will give you clear, unbiased advice on exactly what you can claim with your injuries.

How much compensation do you get for a motorcycle accident?

While there are no set compensation amounts for your motorcycle accident claim, there are guidelines based on injury types. Your claim will cover:

  • Personal injury, with higher amounts for more severe cases
  • Financial losses, such as time off work or travel costs to medical appointments
  • Damages to your vehicle.

Every case is different, and we will help you gather as much evidence as possible to get the payout you deserve. The Judicial Board Guidelines offer historical compensation amounts for injuries by body part.

These do not factor in financial losses or vehicle damage, but offer a helpful starting point. Ranging from minor to severe, you may be able to claim for injuries such as:

  • Head: £1,900 to £350,000
  • Neck: £6,000 to £130,000
  • Back: £2,000 to £141,000
  • Arm: £5,000 to £263,000
  • Leg: £12,000 to £247,000
  • Scarring: £2,000 to £19,000
  • Emotional damage: £3,000 to £88,000.

Can I claim compensation for the full cost of the bike?

You will be able to claim costs for the motorbike based on its value prior to the accident. This means you won’t have a brand-new replacement if your bike wasn’t brand-new. We will factor in the value of the bike at the time of the accident and make claims based on this price.

You can claim for repair damages if your bike is not written off. We’ll help you gather evidence to support this, including repair estimates and invoices, vehicle photos and details such as the age of the bike.

You may also be able to claim for damages to motorbike clothing. Again, you will need photographs and proof of the cost of these items, such as a clothing manufacturer price.

Can I claim for travel expenses?

You can claim for travel expenses if your motorbike was your main mode of travel. You should keep receipts for travel, which will help us claim the full amount. If your bike has been repaired but your injuries prevent you from riding it, you can also claim for alternative transport.

What is the time limit to make a motorcycle accident claim?

You generally have three years from the date of the accident to make a claim. We always advise that you get in touch with us as soon as possible, as this will help us gather the most accurate evidence to support your case.

How do I make a motorbike accident claim?

To make a motorbike injury claim, start by getting in contact with us. Our expert motorcycle injury solicitors will take you through a free consultation and listen to your story. Once we’ve confirmed you can make a claim, we’ll help you gather evidence.

After you’ve submitted your evidence, we’ll make a claim against the relevant organisation – for example, another motorist’s insurer. If they accept, you’ll be awarded your compensation minus our legal fees. If they don’t, we may have to take legal action on your behalf.

We’ll always keep you informed and may be able to help with interim payments. To get the best outcome, we advise getting in touch with us as soon as possible, and gathering as much evidence as you can.

What evidence will I need to make a motorbike crash compensation claim?

To claim as much motorcycle accident compensation as possible, you’ll need strong evidence. We can help you gather this. Your claim should include, where possible:

  • Time and date of the accident with weather conditions
  • The reference number from the police accident report
  • Any medical reports such as doctors’ letters
  • Photographs of damages to your vehicle
  • Photographs of damage to protective wear
  • Witness statements
  • Dashcam or CCTV footage
  • Evidence of financial losses including travel receipts and time off work.

If you’re not sure how to access this information, we can help. You should try to gather this as soon as you can after the accident to make the best claim.

How long will my motorcycle accident claim take?

Motorbike accident compensation claims usually take around six to 12 months to settle, depending on how serious your injuries are. In some cases, they can take longer, such as 18 months. This may be the case if your injuries are very severe or if the claim is disputed – that is, if another driver or company says they were not at fault.

We will do our best to make this process as quick as possible and keep you in the know throughout. We may also be able to help with interim payments, which can cover costs such as travel and motorcycle repairs.

What should I do after a motorcycle accident?

We understand that a motorbike accident can be traumatic, and compensation may be the last thing on your mind. If you are involved in a collision, always prioritise your safety. Get to a safe space out of moving traffic if you can, and assess your injuries. Call an ambulance or ask passersby to help if your injuries are severe.

Once you’re safe, call the police. They can file an accident report, which can be used as evidence in your claim. You should then take down any details you can, such as:

  • The other vehicle’s make, model and registration number, where possible
  • The other driver’s insurance and contact details
  • Contact details from any witnesses
  • Conditions on the day e.g., weather, visibility.

If you or any witnesses have dashcam footage, this may help. You can also see if there is any CCTV nearby that could support your case. Don’t forget to tell your insurer, even if the accident wasn’t your fault. Once you have all this information, you can get in touch with us.

Will you help me while I’m in recovery?

We may be able to help you with interim payments while you’re recovering. These are taken from the final sum of your compensation and can be used for things like repairing your vehicle, or paying for transport to medical appointments. We’ll let you know what you can claim throughout the process.

Fast Access To Support

We’ll get to work straight away so you’re not left waiting. Our team focuses on early evidence gathering and medical assessments to build your case quickly and secure interim payments wherever possible.

You’ll always know what’s happening and what we’re working on — so you can focus on your recovery while we focus on your claim.

Frequently asked questions about motorcycle accident claims

What is the Official Injury Claims Portal?

The Official Injury Claims Portal is a free service designed to help those who have suffered minor injuries in a road traffic accident.

It was set up by the Motor Insurers’ Bureau on behalf of the Ministry of Justice. If your claim is a smaller sum, ranging from £5,000 to £10,000, then we can make it for you through the portal.

For many motorists, the main benefit of going through the portal is that cases are settled faster. They can be finalised within around six months, whereas claims for larger sums may take 12 to 18 months. We can advise you during your no obligation consultation.

What are interim payments?

Interim payments are sums of money paid to you before your final motorbike compensation claim is settled.

These are used to cover ongoing expenses, such as travel to your medical appointments or motorcycle repairs. We can arrange these for you if you need them. The amounts will be deducted from your final compensation.

Can I claim if the motorcycle accident was partly my fault?

You can still claim if you were partly at fault for the motorcycle accident.

Both you and the other party will need to submit your evidence, after which a court will decide how much you are at fault.

This is calculated as a percentage, so you will receive a percentage of your total claim. For example, if you were deemed 50% at fault, you would receive 50% of the total sum.

Will I need to have a medical?

In most cases, you will need evidence signed off by a medical professional to support your claim.

We will make sure this is as comfortable as possible for you. Some companies may offer a pre-medical to speed up your case. We would advise against this as it may encourage you to take a smaller settlement.

Will I have to go to court?

In most cases, you will not have to go to court. We do our best to settle all motorcycle injury claims out of court, but there are some rare exceptions.

If the other driver’s insurer disputes the claim, or if your injuries are complex, we may have to represent you. We will let you know if you do need to get to court and make sure this process is as comfortable as possible.
