Carol’s fight for justice following incorrect surgery which left her permanently disabled

In 2017, following previous negative advice from her former solicitors, a tenacious Carol approached Wolferstans Solicitors to continue pursuing her claim for medical negligence.

Carol, aged 56, was scheduled to undergo a knee replacement surgery to address her knee condition, which was characterised by damage to the ACL (Anterior Cruciate Ligament) and arthritis in the outer compartment of her knee joint.

Sadly, due to an incorrect recording from a MRI scan, a partial knee replacement was performed on the wrong side of her left knee. This negligence resulted in Carol’s ongoing disability, where she has had to undergo further extensive surgery.

Prior to the operation, Carol was highly fit and active. She enjoyed swimming, gardening, and had a busy social life being a core figure for her family and friends. As a consequence of the incorrect operation, Carol’s knee is very painful. She is unable to stand unaided for any useful period of time, relies on crutches to walk, and requires assistance with daily activities. Her hobbies and social life have been severely impacted.

Rather than struggle on with injuries which were not her fault, Carol fought to find solicitors who would help her with her claim. She refused to accept negative advice from her former solicitors and, instead, worked with Peter Tassart, a Partner and Solicitor Advocate in Wolferstans’ expert Medical Negligence department. Peter later succeeded in winning Carol’s claim and securing her compensation in 2022.

The hospital initially denied fault but had to capitulate, eventually, in light of the evidence obtained by Peter in the ensuing court case. Whilst the hospital apologised to Carol for the negligent operation, her disabling injuries cannot be undone. The damages Wolferstans secured for her will allow her to adapt her home and provide her with as much independence as possible in order to cope with her injuries.

Thankfully, with her sheer determination matched with Peter’s expertise, Carol has been able to accommodate and manage the significant disability she was left with.
